Dallas Anchor Arrested on Vacation; "I was an a--hole."

Turned out to be a pretty crappy vacation for KTVT-TV anchor Brendan Higgins in Aspen, CO. According to police, Higgins tried to punch an employee of The Residences At the Little Nell. When police arrived, Higgins told them he was an a--hole. When they placed him under arrest he became belligerent and said, "I'm going to beat you until you're dead." According to the police report, Higgins was so violent they had to use a Ripp restraint. In case you're not from Texas, that's kinda like 'hog tie". 

Higgins is due in court on September 10th. Maybe a 5-part series for sweeps is in order ending with, "Resume writing & Demo making"?

On 8/6/14 at about 0038 hours, I Officer Greggory Cole, responded to a report of 
a disturbance at the Residences at the Little Nell, located at 501 Dean Street. 
It was reported that a male guest had punched a driver and was being violent 
with the staff. 
I arrived on scene with Offices Jeff Fain, Adam Loudon, and Dave Rosselot. 
Officer Fain and I were directed towards the elevator where a male, later 
identified as Brendan Higgins (DOB 12/04/67), had last been seen. We opened the 
elevator and Higgins was standing inside. 
We asked Higgins to exit the elevator and he complied. Higgins had the strong 
odor of an alcoholic beverage on his breath, slurred speech, bloodshot and 
watery eyes. 
We asked Higgins what had happened and he said "I was an asshole." Higgins then 
began laughing. Higgins denied hitting anyone. Officer Fain informed Higgins 
that he was under arrest and placed him in handcuffs, double locking them and 
checking them for proper fit. Higgins then became angry and began calling 
Officer Fain and I names. Higgins said "You fucking pieces of shit" and "I'm 
going to beat you until you're dead." Higgins then attempted to strike me using 
a swiping motion with his hands. I pushed Higgins towards the elevator doors, 
which he was standing a few inches from. Higgins hit the elevator with his head 
and then pretended to pass out and slumped to the floor. I could tell that 
Higgins had not actually passed out because he was giggling. 
Officer Fain and I stood Higgins up and escorted him out of the building. We 
called for an ambulance to respond to our location to evaluate Higgins. We sat 
Higgins down and he continued to try to stand up, despite our requests to stay 
seated. Higgins began making kicking motions. Officers Fain, Rosselot, Loudon, 
and I then picked Higgins up, and gently placed him on the ground. Higgins 
continued to struggle and threaten us with bodily harm. A nylon leg restraint 
was placed around Higgins' legs in order to keep him from kicking. 
Medics arrived and examined Higgins. I asked Higgins if he had diabetes and he 
said yes. When asked if he had type I or type II diabetes, Higgins did not 
respond. I asked Higgins if he had type 0 diabetes (which does not exist) and he 
stated that he did. Higgins repeatedly threatened the medics. 
The medics chose to transport Higgins to the Aspen Valley Hospital where he was 
evaluated and eventually discharged at about 0530 hours. Once he was discharged 
from the hospital I transported Higgins to the Pitkin County Jail. Once at the 
Jail I attempted to served Higgins with a Summons, but he was still too 
intoxicated to provide me with his basic biographical information. I completed 
APD Summons A 15525, charging Higgins with Disorderly Conduct 15.04.300(d) and 
Resisting or Interfering with an Officer 15.04.120(a) to be served to Higgins 
when sober.

On 8/6/14 at approximately 0038 hours dispatch aired a report of a 
disturbance that was taking place at the Residences at Little Nell, 501 E. Dean 
Street, City of Aspen, County of Pitkin, State of Colorado. Dispatch advised 
that hotel staff had called because there was an intoxicated male who was 
becoming violent. 
I responded to the scene and arrived after officers Jeff Fain, Adam 
Loudon, and Gregg Cole. Upon my arrival, I entered the hotel and observed 
Loudon speaking to a hotel employee and the wife of the suspect (see his 
narrative for details). 
I heard on the radio that Fain and Cole were in contact with the 
suspect, who was identified as Brendan Higgins. Hotel employee Anders Norstebon 
began leading me towards Fain and Cole's location. 

Norsteban then explained to me the following: 
-He had assisted the driver from Hotel Jerome (who had just unloaded Higgins 
from his vehicle along with his wife) in carrying Higgins into the Nell. 
-He was assisting Higgins in reaching his hotel room, and while waiting for the 
elevator Higgins suddenly became belligerent and attempted to punch Norsteban. 
-Higgins attempt at punching him was futile due to his level of intoxication, 
and he was able to duck out of the way. 
-Higgins continued his attempts to punch and fight with him until police 
arrived. 
While speaking with Norsteban, I heard a muffled, banging-noise come 
from down the hall. I walked down the hall and observed Higgins laying on the 
ground near Cole and Fain. Cole explained that Higgins had attempted to punch 
him. 

Higgins was placed into handcuffs and placed under arrest for disorderly 
conduct. I observed that Higgins had a very strong odor of unknown alcoholic 
beverage coming from his breath, and observed that his eyes were watery. 
Higgins appeared to be having trouble forming complete sentences, and made 
several comments about how he would "kick our ass" and "beat us to death." 
Higgins was walked to the front entrance of the hotel where I radioed 
for an ambulance to come to our location to evaluate Higgins for a cut to the 
bridge of his nose. While awaiting the arrival of the ambulance, Higgins became 
belligerent, stood up and took an aggressive stance towards officers on scene 
while mumbling about fighting with us. Higgins was placed lowered to the ground 
and a RIPP restraint placed on around his ankles to keep his from kicking us. 
Higgins eventually calmed and were were able to sit him up without 
incident until paramedics arrived. Once paramedics arrived on scene, Higgins 
became uncooperative and belligerent again. Medics transported Higgins to Aspen 
Valley Hospital for further medical attention. 
I subsequently retrieved video from the Residences which I have added to 
the case file as evidence DR112-1. The video shows Higgins' arrival at the 
hotel and him being escorted out by police.

On August 6, 2014 at 0038 hours a disturbance call was aired a the 
Residences at the Little Nell, 501 E Dean St in the City of Aspen. Dispatch 
aired that a guest was becoming violent. Officer Gregg Cole, Dave Rosselot, 
Jeff Fain and I arrived on scene within a few minutes. We were met with a 
member of security later identified as Anders K Norstebon, DOB 02/06/79. 
Norstebon said that the suspect had punched someone. Officer Cole and Fain went 
and contacted the suspect later identified as Brendan Patrick Higgins, DOB 
12/04/67. 
I met with one of the witnesses to the incident Cory Gates, DOB 
12/02/61. Gates told me that he was driving Higgins and his wife(Jenna Turner 
Alexander 08/29/77) from the Hotel Jerome. He and Norstebon were helping carry 
Higgins from the car to the elevator because of Higgins' extreme intoxication. 
Once at the elevator Higgins was staggering around and struck Gates in the face 
with his right fist. I looked at Gates' face and saw that his left cheek was 
red and beginning to swell. I asked Gates if he wanted to press charges for 
assault. Gates said he did not. 
I told Gates that Higgins would most likely be arrested for disorderly 
conduct. Turner-Alexander agreed saying that this was not the first time this 
sort of incident has occurred with Higgins. I met with Officer Fain and Cole 
who were with Higgins by the elevator. Higgins had apparently fallen due to his 
intoxication and received a small cut on the bridge of his nose. Officer Fain 
and Cole escorted Higgins to the front entrance and requested an ambulance to 
have Higgins looked over. 
Officer Fain had Higgins sit down while we waited because of Higgins' 
high intoxication. While waiting for the medics Higgins attempted to stand up 
from a seated position a few times. Higgins at one point started to stand up, 
pull away from Officer Fain and attempt to kick the officers on scene. Officer 
Fain, Cole, Rosselot and I escorted Higgins to the ground where he again 
attempted to kick. Higgins was placed in hobble restraint and sat him on on the 
ground. 
A few minutes later Aspen Ambulance Paramedics arrived on scene to 
evaluate Higgins. Higgins was extremely uncooperative with the medics telling 
them that he was "going to beat them till they die". Higgins also attempted to 
bite a medic that was putting a bandage on his nose. The medic decided to 
transport Higgins to Aspen Valley Hospital due to his intoxication and his 
inability to answer simple questions. Officer Fain accompanied Higgins to AVH 
with the medics.
