First off, you can be a rioter and not be arrested.

Do you think that everyone that was rioting at the U.S. Capitol yesterday was arrested?

If you are watching a person push and shove police before throwing a rock with the window on the Capitol building, that person is a rioter, makes no difference if they are arrested or not.

People that were destroying property during the Black Lives Matter protests were rioters and so were the people that attacked and laid siege to the U.S. Capitol yesterday.
