Opening Statements Start in Erin Andrews Peephole Case

The jury has been seated in the Erin Andrews peephole case.

Today, opening statements from attorneys in the civil trial for Fox Sports Reporter's negligence lawsuit against a Nashville Marriott hotel and others will begin.

Andrews is seeking $75 million in damages, accusing the hotel and others of allowing Michael David Barrett to book rooms next to her and to rig peepholes through which he filmed videos of her changing clothes.

Court documents say Barrett then posted the videos on the Internet.

In her lawsuit, Andrews said the incident happened in 2008 at the Nashville Marriott at Vanderbilt University, while she was visiting the city to cover one of the university’s football games.

When media arrived to cover the court proceedings Monday, reporters were originally kept out of the courtroom during jury selection because of Circuit Court Judge Hamilton Gayden’s interpretation of Rule 30 pertaining to media access.

Reporters were later allowed to enter for the final moments of jury selection, just before court recessed for the day, after a lawyer for The Tennessean and WSMV intervened.

Andrews is suing Nashville Marriott at Vanderbilt University, Windsor Capital Group and Barrett. Her lawsuit accuses the Marriott of negligence, infliction of emotional distress and invasion of privacy.
